Access to Work - employer and employee co-operation

Overview

The Employment Appeal Tribunal has held that an employee's refusal to co-operate in the process of applying for Access to Work frustrated the employer's attempt to assist the employee with his disability.


In the case of Mr M Bishun v Hertfordshire Probation Service (National Probation Service), the EAT was asked to consider whether the employer had failed to make reasonable adjustments as to the provision of equipment where the employee, Mr Bishun, had not taken steps to apply for Access to Work despite being asked to do so.
